Booking Terms and Conditions
These terms apply to all clubs, courses, workshops and events run by UK Art Spotlight.

1. Who we are
1.1 Events are provided by Ghazal Felan, a sole trader trading as UK Art Spotlight (“we”, “us”, “our”), whose business address is Unit 5 Aire Street, Leeds LS1 4HT.
1.2 Our studio and gallery is at Unit 5 Aire Street, Leeds LS1 4HT. Unless we tell you otherwise when you book, this is where events take place.
1.3 You can contact us at hello@UKartSpotlight.org. We aim to respond within 2 working days. Where these terms ask you to give us notice in writing, an email to that address is enough.
1.4 If we need to contact you, we will use the email address or telephone number you gave when booking. Please keep those details current and check your spam folder for messages from us.
2. What these terms cover
2.1 These terms apply to every ticket or place you book with us. In these terms, an “Event” means any club session, course, workshop, class or other activity we sell a ticket or a place for.
2.2 Different types of Event have different rules about moving, cancelling and refunding a booking. Those rules are set out in Schedule 1 at the end of these terms, and they form part of your contract with us. The rule that applies to your booking is the one shown for that Event when you book.
2.3 Where we add a new type of Event, we will add it to Schedule 1 and show its cancellation rule on the booking page before you pay.
2.4 The details specific to your booking — the date, time, price and what is included — are those shown on the Event page and in your booking confirmation. Where anything there conflicts with these general terms, the Event page and your confirmation take priority.
2.5 We supply Events to you as a consumer. Nothing in these terms reduces or removes your legal rights, and if any term here conflicts with a right you have by law, your legal right applies.
2.6 The version of these terms that applies to your booking is the version in force on the day you book. Later changes do not affect bookings you have already made.
3. Booking and your contract with us
3.1 When you complete the booking form and pay, you are offering to book a place. Your contract with us comes into existence only when we send you a booking confirmation by email.
3.2 Before you pay we will show you the cancellation rule for the Event you are booking, and you will be asked to confirm that you accept these terms. You cannot complete a booking without doing so.
3.3 If we cannot accept your booking — for example because the Event has filled, because the price or description was wrong, or because we cannot meet an access or health requirement you have told us about — we will tell you and will not charge you. If you have already been charged, we will refund you in full.
3.4 Please check your booking confirmation when it arrives and tell us straight away if anything is wrong.
3.5 Unless we say otherwise on the Event page, Events are for adults and the minimum age is 16. If the participant is under 18, a parent or guardian must make the booking, accept these terms on their behalf and remain responsible for them.
4. Price and payment
4.1 The price of an Event is the price shown at checkout at the time you book, and includes VAT where applicable.
4.2 Early bird and other promotional prices are limited in number and available only while shown. We may withdraw them at any time, but doing so will never change the price of a booking you have already made.
4.3 Payment is due in full when you book, unless an instalment option is offered for that Event. Your place is held only once payment has been taken or an instalment plan has been approved.
4.4 Where you pay using Klarna or another instalment provider:
(a) you enter into a separate agreement with them, governed by their own terms, which you should read before you use it;
(b) cancelling your booking with us does not by itself cancel that agreement, and you remain responsible for payments to them until they confirm otherwise; and
(c) where a refund is due under these terms, we will pay it to them, and they will then adjust or refund your plan. This can take longer than a refund to a card.
4.5 It is always possible that a price on our website is wrong. If the correct price is higher than the price shown, we will contact you before accepting your booking, and you may either confirm at the correct price or cancel with a full refund.
5. Moving your booking to another date
5.1 For Events where Schedule 1 says you can move to another date, you may do so at any time before the Event starts, free of charge, by emailing us. Your new date is confirmed once we reply to say so.
5.2 You can move a booking to any equivalent Event with a place available in the following 3 months. If the Event you move to costs more, you pay the difference; if it costs less, the balance stays as credit and can be used in that same period.
5.3 We may limit a booking to two moves. After that we will ask you to take a credit voucher instead, so that we can plan session numbers.
5.4 Moving a booking does not extend the deadline for cancelling with a refund. That deadline is measured from the date of the Event you originally booked.
6. Cancelling your booking
6.1 Before the refund deadline for your Event. You may cancel and receive a full refund of everything you have paid. The deadline for each type of Event is set out in Schedule 1.
6.2 After the refund deadline, including once the Event has started. We are not able to offer a refund, because at that stage we are holding a place we are unlikely to be able to fill. Instead, depending on the Event, you may move to another date under clause 5, transfer your place under clause 7, or take a credit voucher under clause 8. Schedule 1 shows which of these apply.
6.3 If you book after the refund deadline has already passed. No refund is available, because the deadline had gone before you booked. Clause 6.2 applies from the moment your booking is confirmed.
6.4 To cancel, email us at hello@UKartSpotlight.org. Your cancellation takes effect when we receive your email, so please keep a copy. We will confirm receipt.
6.5 Where a refund is due, we will make it using the same method you paid with, within 14 days of the day we receive your cancellation.
6.6 Nothing in this clause affects your rights if we cancel or significantly change an Event (clause 11), if something outside anyone’s control prevents it going ahead (clause 12), or if it is not carried out with reasonable care and skill (clause 13).
7. Transferring your place to someone else
7.1 You may transfer your place to another person at any time before the Event starts, free of charge. Tell us their name and contact details, and anything we need to know about their health or access needs, at least 48 hours beforehand so that we can prepare.
7.2 The person taking your place must be eligible under clause 3.5 and must accept these terms. Once they do, the contract is between us and them.
7.3 For a multi-week course, a transfer after the course has started is not permitted.
7.4 Any money that changes hands between you and the person taking your place is a matter between the two of you. We will not split a refund or a voucher between you.
7.5 Places may not be resold for more than the price you paid, and may not be resold in the course of a business, without our written agreement.
8. Credit vouchers
8.1 Where you are entitled to a voucher under these terms, we will issue it for the full amount you have actually paid us.
8.2 Vouchers are valid for 12 months from the date we issue them and can be used against any UK Art Spotlight Event, subject to availability when you book.
8.3 If the Event you choose costs less than the voucher, the balance stays on your voucher and remains available until it expires. If it costs more, you pay the difference.
8.4 A voucher may be transferred once to a named person. Vouchers cannot be exchanged for cash.
8.5 We will remind you by email before your voucher expires. If you cannot use it in time for a reason you tell us about, please contact us — we will consider extending it, though we are not obliged to.
8.6 This clause does not apply where a voucher is offered because we cancelled or changed an Event. In that situation you may always choose a refund instead — see clause 11.
9. If you do not attend
9.1 If you do not attend and have not moved or cancelled your booking beforehand, there is no refund, credit or replacement session.
9.2 For clubs, moving your booking is free right up until the session starts — so if something comes up, a quick email before the start time protects the value of your ticket.
9.3 For a multi-week course, missing a session does not entitle you to a partial refund or a replacement session. Let us know as early as you can, and where it is practical we will help you catch up, though we cannot guarantee this.
10. What is included
10.1 What your ticket or place includes is described on the Event page. Unless it says otherwise, all materials used during the Event are provided.
10.2 Where we describe the individual elements of an Event as having a value, those figures describe what we consider each element to be worth. They are not separate items you are buying, and they cannot be refunded, credited or removed from your booking individually. Each Event is sold as a single package at the price shown at checkout.
10.3 Where an Event includes access to our clubs as part of the package, that access has no cash value, cannot be exchanged for a voucher or refund on its own, and must be used within the duration of the Event.
10.4 Where an Event includes an item for you to keep, such as an artist kit, it becomes yours when we give it to you. If a refund later becomes due to you, we may either deduct its cost or ask you to return it unused, at your choice.
11. If we change or cancel an Event
11.1 We may occasionally need to reschedule an Event or a session within it, for example because a tutor is ill or the studio is unavailable. We will give you as much notice as we can and offer an alternative date.
11.2 If we cancel an Event, or make a change to it that is significant and you do not accept, you may choose either:
(a) a full refund of everything you have paid, or of a fair proportion of it if part of a course has already been delivered; or
(b) a credit voucher, if you would rather move to something else.
11.3 The choice in clause 11.2 is yours, not ours. We will not offer you a voucher in place of a refund you are entitled to.
11.4 We will pay any refund under this clause within 14 days, using the method you paid with.
11.5 Descriptions of what an Event will cover are indicative. We may make reasonable changes to the running order, the projects covered or the tutor delivering a session without that being a significant change.
12. Events outside our control
12.1 We are not responsible for delays or failures to deliver an Event caused by circumstances outside our reasonable control — for example severe weather, fire or flood at the studio, loss of power or utilities, or restrictions imposed by a public authority.
12.2 If this happens we will contact you as soon as we can and will reschedule. If an Event is delayed by more than four weeks, either you or we may cancel it, and we will refund you for anything not delivered.
13. Our responsibility to you
13.1 We will provide our Events with reasonable care and skill, as required by the Consumer Rights Act 2015.
13.2 If we do something badly or fail to do what we agreed, we are responsible for loss or damage you suffer that is a foreseeable result of that. We are not responsible for loss or damage that was not foreseeable — meaning it was neither obvious that it would happen nor something you told us about before we accepted your booking.
13.3 We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the Event.
13.4 We provide Events for private and domestic use. If you use one for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
13.5 Please keep your belongings with you. We are not responsible for personal property brought to the studio or to an exhibition, except where loss or damage is caused by our negligence.
14. Health, safety and conduct
14.1 Please tell us when you book about any medical condition, allergy, pregnancy, or access or learning requirement we should know about. Sessions involve materials such as acrylic paints, oil pastels, charcoal, solvents and hand tools including palette knives.
14.2 You must follow the reasonable safety instructions given by our tutors and studio staff.
14.3 We may ask a participant to leave, and end their booking without a refund, if their behaviour puts anyone’s safety at risk, seriously disrupts the session for others, or amounts to harassment or discrimination. Except where the behaviour is serious enough that immediate action is needed, we will raise the problem first and give them a chance to put it right.
14.4 Please arrive on time. Tutors may not be able to repeat material for late arrivals, and for safety reasons we may not be able to admit someone who arrives after a demonstration has begun.
15. Your artwork, photography and exhibitions
15.1 You own the copyright in the work you create at our Events.
15.2 Unless you tell us otherwise, you give us permission to photograph your work and to use those photographs to promote UK Art Spotlight, crediting you as the artist. You can withdraw this permission at any time by emailing us, and we will stop using the images in new material.
15.3 We may take photographs or video at Events and exhibitions in which participants appear. If you would prefer not to appear, tell us in writing and we will respect that.
15.4 Please take your work home with you, or collect it within 30 days where it is being kept for an exhibition. We will contact you if work is left behind, and if it is still uncollected 90 days later we may dispose of it.
16. Your personal information
16.1 We use your personal information in accordance with UK data protection law and our privacy notice, available at ukartspotlight.org/privacy-policy, which explains what we collect, why, how long we keep it and what rights you have.
16.2 We will only send you marketing emails if you have agreed to receive them, and you can unsubscribe at any time.
17. Complaints
17.1 If something has gone wrong, please tell us as soon as possible at hello@UKartSpotlight.org so that we have a chance to put it right. We will acknowledge your complaint within 5 working days and aim to respond fully within 20 working days.
17.2 If we cannot resolve matters between us, you can get free, impartial advice from Citizens Advice, and you retain the right to take the matter to court.
18. Other important terms
18.1 We may transfer our rights and obligations under these terms to another organisation. If we do, we will tell you in writing, and it will not affect your rights.
18.2 This contract is between you and us. No one else may enforce it, other than a person to whom you transfer your place under clause 7.
18.3 Each clause operates separately. If a court decides that any clause is unlawful, the remaining clauses stay in force.
18.4 If we delay in enforcing any part of these terms, that does not prevent us from enforcing it later.
18.5 We may update these terms for future bookings. Changes will not affect a booking you have already made.
18.6 These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts there.
Schedule 1 — Moving, cancelling and refunding your booking
This schedule forms part of these terms. The rule that applies to your booking is the one shown for that Event when you book.
Drawing Club — drop-in session, £10
Move to another date: any time before the session starts, free of charge.
Cancel for a full refund: more than 7 days before the session.
After the refund deadline: no refund, but you can still move to another date, or take a credit voucher.
Painting Club — drop-in session, £29
Move to another date: any time before the session starts, free of charge.
Cancel for a full refund: more than 7 days before the session.
After the refund deadline: no refund, but you can still move to another date, or take a credit voucher.
6 Week Beginner Painting Course — multi-week course
Move to another date: not available — places are held in a cohort of five.
Cancel for a full refund: more than 14 days before the first session.
After the refund deadline: no refund, but you can transfer your place to someone else, or take a credit voucher.
Workshops and other one-off events
Move to another date: any time before the event starts.
Cancel for a full refund: more than 7 days before the event.
After the refund deadline: no refund, but you can transfer your place, or take a credit voucher.
Notes

Deadlines are counted back from the start time of the Event you booked — for a multi-week course, from the start of the first session.

Moving a booking to a later date does not give you a new refund deadline (clause 5.4).

If we cancel or significantly change an Event, you choose between a refund and a voucher, whatever this schedule says (clause 11).

Free events and exhibition openings are not ticketed and are not covered by this schedule. We may change or cancel them without liability, and will tell you as early as we can.
